SMS messaging program

Program: When you opt in, Native States sends account, lead-notification, service, and appointment text messages within the scope described when consent is collected.
How to opt in: SMS opt-in is collected through an optional website checkbox or verbally during an inbound call after the agent reads the consent disclosure. The checkbox is unchecked by default, and verbal consent requires a clear yes. SMS consent is not required to create an account, request a demo, book an appointment, make a purchase, or use Native States services. See our SMS Consent Methods.
Message frequency: Varies based on your account activity and incoming leads. Verbal appointment consent covers appointment confirmations and up to three appointment updates.
Cost: Message and data rates may apply, per your mobile carrier plan.
Opt out: Reply STOP at any time to cancel. You will receive one confirmation message and then no further messages.

Carriers: Carriers are not liable for delayed or undelivered messages.

1. The service

Native States provides software that detects missed calls and inbound leads for local service businesses and responds with automated text replies, owner alerts, and follow-up sequences. You are responsible for the accuracy of the information you provide and for using the service in compliance with applicable laws.

2. Your responsibilities for end-customer messaging

When Native States sends messages to your customers on your behalf, you represent that you have a prior relationship with, or appropriate consent from, those recipients as required by applicable law (including the TCPA and carrier rules). You are responsible for the content and rules you configure.

3. Acceptable use

You agree not to use the service for unlawful, deceptive, harassing, or unsolicited bulk messaging, or for any content prohibited by carriers (such as the regulated “SHAFT” categories). We may suspend the service for violations.

4. Fees

Subscription fees, if any, are described at sign-up. Fees are non-refundable except as required by law.

5. Disclaimers & limitation of liability

The service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Native States is not liable for indirect, incidental, or consequential damages, or for lost leads, revenue, or undelivered messages.

6. Changes

We may update these terms from time to time. Material changes will be posted on this page with a revised “Last updated” date.
